Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using the CashWrench platform (the “Service”), you (“User”, “you”) agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
If you do not agree to these Terms in full, you must not use the Service.
2. The Service
CashWrench provides a cloud-based field service management platform for independent trade contractors, including tools for estimating, quoting, invoicing, job tracking, and outbound SMS communication. The Service is provided on a subscription basis as described in Section 4.
CashWrench reserves the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.
3. Account Registration
You must provide accurate, current, and complete information when creating your account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must notify CashWrench immediately at support@cashwrench.com if you suspect unauthorised access to your account. CashWrench is not liable for any loss resulting from unauthorised use of your account.
You must be at least 18 years of age to use the Service.
4. Subscription, Billing & Cancellation
4.1 Free Trial
New accounts receive two (2) calendar months of free access to the Service (“Free Period”). No credit card or payment information is required to begin the Free Period. CashWrench will send you a reminder notification via SMS and email before your Free Period ends.
4.2 Paid Subscription
After the Free Period expires, continued use of the Service requires a paid subscription. Your subscription will be billed monthly at the rate displayed at the time of sign-up. Current pricing is $19/month for accounts that signed up during the Founder early access period (“Founder Rate”).
By providing payment information and continuing to use the Service after the Free Period, you authorise CashWrench to charge your payment method on a recurring monthly basis until you cancel.
4.3 Billing Date
Your monthly billing date is set on the day your paid subscription begins (the day after your Free Period ends). Billing recurs on the same calendar date each month. If that date does not exist in a given month (e.g. the 31st), billing will occur on the last day of that month.
4.4 Cancellation
You may cancel your subscription at any time through your account settings. To avoid being charged for the next billing cycle, you must cancel at least 48 hours before your next scheduled billing date. Cancellations made within 48 hours of the next billing date may not be processed in time to prevent that charge.
Cancellation takes effect at the end of the current paid billing period. You will retain access to the Service until the end of the period for which you have already paid.
4.5 No Refunds
All subscription payments are non-refundable. Once a billing cycle has been processed and payment has been collected, no refund, credit, or proration will be issued for that billing period — including for partial months, unused time, or cancellations made after the billing date.
This no-refund policy applies to all charges, including cases where:
- You forgot to cancel before the billing date
- You did not use the Service during the billing period
- You cancelled the same day as being charged
The 48-hour cancellation window in Section 4.4 is your mechanism to prevent future charges. CashWrench will not waive this policy.
4.6 Failed Payments
If a payment fails, CashWrench may retry the charge and/or suspend your access to the Service until payment is successfully collected. You are responsible for keeping your payment information current.
4.7 Founder Pricing
The Founder Rate is locked at $19/month for the life of your continuous active subscription. If you cancel your subscription and later resubscribe, the Founder Rate will not be reinstated and your new subscription will be billed at the then-current rate.
4.8 Price Changes
CashWrench reserves the right to change subscription pricing for new subscribers at any time. Existing subscribers on Founder pricing are not affected as long as their subscription remains active and continuous (see Section 4.7).
For all other subscribers, CashWrench will provide at least 30 days’ written notice of any price increase before it takes effect.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Send unsolicited commercial messages (spam) or messages that violate applicable laws including the Telephone Consumer Protection Act (TCPA)
- Impersonate any person or entity or misrepresent your affiliation
- Introduce malicious code, viruses, or disruptive software
- Attempt to gain unauthorised access to any part of the Service or its infrastructure
- Resell, sublicense, or commercially exploit the Service without written permission from CashWrench
CashWrench reserves the right to suspend or terminate accounts that violate this section without notice and without refund.
6. Intellectual Property
The Service, including all software, content, branding, and documentation, is owned by CashWrench and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.
You retain full ownership of all data, customer information, and content you upload or create through the Service (“Your Data”). By using the Service, you grant CashWrench a limited licence to store, process, and transmit Your Data solely to provide the Service to you.
7. Data & Privacy
CashWrench collects and processes personal data as described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to that data processing.
You are responsible for ensuring that your use of the Service — including any SMS messages sent through the platform — complies with applicable privacy and communications laws, including but not limited to the TCPA.
8. Disclaimers
The Service is provided on an “as is” and “as available” basis. CashWrench makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted or error-free operation.
CashWrench does not warrant that the Service will meet your specific requirements or that any errors will be corrected.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- CashWrench’s total liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total subscription fees you paid to CashWrench in the three (3) months immediately preceding the event giving rise to the claim.
- CashWrench shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, even if advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, CashWrench’s liability is limited to the greatest extent permitted by law.
10. Indemnification
You agree to indemnify, defend, and hold harmless CashWrench and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.
11. Termination
CashWrench may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination include but are not limited to violation of these Terms or non-payment.
Upon termination, your right to use the Service ceases immediately. Sections 4.5, 6, 8, 9, 10, and 12 survive termination.
You may export your data prior to termination. CashWrench is not obligated to retain your data after account termination and may delete it after 90 days.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Any dispute arising out of or related to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration in Sacramento, California under the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration against CashWrench.
Nothing in this section prevents either party from seeking emergency injunctive relief from a court of competent jurisdiction.
13. Changes to These Terms
CashWrench reserves the right to update these Terms at any time. When we do, we will update the “Last updated” date at the top of this page and notify you via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
If a change materially affects your rights, we will provide at least 14 days’ notice before the change takes effect.
14. Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and CashWrench regarding the Service and supersede all prior agreements, representations, or understandings.
